BEATTRYBE TERMS AND CONDITIONS
Effective Date: 5th, of March 2025
1. Acceptance of Terms
By accessing or using BeatTrybe (“Platform”), you agree to be legally bound by these Terms. If you do not agree, you must discontinue use immediately.
2. Nature of the Platform
BeatTrybe is a digital music marketplace and distribution platform that enables artists to sell and distribute their content directly to fans.
BeatTrybe does not own user-uploaded content and operates solely as an intermediary platform.
3. Eligibility
You must be at least 13 years old to use BeatTrybe. If you are under 18, you must have parental or guardian permission.
4. Account Responsibility
- You must provide accurate and complete information
- You are responsible for maintaining the confidentiality of your account
- You are liable for all activities under your account
5. Artist Accounts & Earnings
5.1 Revenue Model
- Artists may set prices between ₦500 – ₦2,500
- Artists earn 75% of each sale
- BeatTrybe retains 25% as a platform fee
5.2 Payments
- Earnings are credited to artist wallets
- Withdrawals may be subject to identity verification (KYC), processing fees, and minimum thresholds
5.3 Taxes
Artists are solely responsible for all applicable taxes and regulatory obligations.
6. User Conduct
You agree not to:
- Upload unauthorized or infringing content
- Violate any applicable laws
- Engage in fraudulent or abusive activity
- Use automated systems to access the platform
7. Content Ownership & Licensing
7.1 Ownership
Artists retain full ownership of their uploaded content.
7.2 License to BeatTrybe
By uploading content, you grant BeatTrybe a non-exclusive, worldwide, royalty-free license to host, distribute, promote, and sell your content on the platform.
8. Artist Warranties
By uploading content, you represent and warrant that:
- You own all rights to the content or have obtained all necessary licenses
- Your content does not infringe any copyright, trademark, or third-party rights
- Your content does not contain unauthorized samples or material
You are solely responsible for any legal consequences arising from your content.
9. Copyright Infringement & Takedown Policy
BeatTrybe respects intellectual property rights.
If you believe your work has been infringed, you may submit a notice including:
- Proof of ownership
- Identification of the infringing content
- Your contact details
BeatTrybe may remove the content, suspend accounts, and take further action where necessary. Repeat offenders may be permanently banned.
10. Indemnification
You agree to defend, indemnify, and hold harmless BeatTrybe, its owners, and affiliates from any claims, damages, liabilities, or expenses arising from:
- Your use of the platform
- Your uploaded content
- Your violation of these Terms
11. Content Moderation & Removal Rights
BeatTrybe reserves the right to remove content or suspend accounts at its sole discretion, including where content:
- Violates laws
- Infringes rights
- Poses legal or reputational risk
12. Payments, Refunds & Disputes
- All purchases are final and non-refundable unless required by law
- BeatTrybe is not responsible for disputes between users
13. Platform Availability
The platform is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free service.
14. Limitation of Liability
BeatTrybe shall not be liable for:
- Loss of profits or revenue
- Data loss
- Indirect or consequential damages
- Disputes between users
15. BEATTRYBE TERMS AND CONDITIONS ON CHILD SEXUAL ABUSE AND EXPLOITATION (CSAE)
15a. Introduction
BEATTRYBE is committed to maintaining a safe and responsible digital platform for artists and music lovers. We have a zero-tolerance policy for any content or behavior that promotes, supports, or enables child sexual abuse and exploitation (CSAE). These terms outline our strict policies and actions to prevent, detect, and remove such content from our platform.
15b. Prohibited Content and Activities
The following activities and content are strictly prohibited on BEATTRYBE:
- Uploading, sharing, distributing, or promoting any material that depicts or exploits minors in a sexual manner
- Engaging in any form of child grooming, exploitation, or solicitation through our platform
- Using BEATTRYBE to contact, harass, or manipulate minors for illegal or inappropriate purposes
- Creating or promoting content that normalizes or glorifies child sexual abuse or exploitation
- Failing to report CSAE-related content or activity if discovered on the platform
15c. Enforcement and Reporting
BEATTRYBE actively monitors and investigates any suspected CSAE-related violations. Actions we may take include:
- Immediate removal of prohibited content
- Permanent suspension or banning of offending users
- Reporting illegal activity to law enforcement and relevant child protection agencies
- Cooperating fully with authorities in any investigation
Users are encouraged to report any suspected CSAE content through in-app tools or by contacting support.
15d. Legal Compliance
BEATTRYBE adheres to applicable child protection laws, including:
- The Nigerian Child Rights Act
- The U.S. PROTECT Act
- The United Nations Convention on the Rights of the Child
15e. User Responsibility
All users must comply with these terms. Violations may result in legal action and prosecution.
16. Privacy Policy
Your use of BeatTrybe is also governed by our Privacy Policy.
17. Termination
BeatTrybe may suspend or terminate accounts at any time for violations of these Terms. Users may also terminate their accounts at any time.
18. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria.
19. Dispute Resolution
Parties agree to attempt to resolve disputes amicably before initiating legal proceedings.
20. Changes to Terms
We may update these Terms at any time. Continued use of the platform constitutes acceptance of the revised Terms.
